Welcome to MoveRebate. These Terms of Service ("Terms") govern your access to and use of the MoveRebate website, including apartment search tools, apartment locating services, rebate opportunities, forms, communications, and related services offered through the website.

By accessing or using MoveRebate, you agree to these Terms. If you do not agree to these Terms, please do not use the website.


1. WEBSITE PURPOSE

MoveRebate provides apartment search information, apartment locating assistance, information regarding rental communities, and information regarding potential renter rebate opportunities.

Real estate and apartment locating services offered through MoveRebate are provided through a licensed Florida real estate sales associate operating under US Realty Hub, the licensed real estate brokerage.

MoveRebate is a marketing brand used in connection with these services and is not a separate real estate brokerage.

Information provided through MoveRebate is for general informational purposes and is not legal, financial, tax, insurance, or housing advice.


2. APARTMENT INFORMATION

MoveRebate may provide information regarding apartment communities, including:

• Rental rates
• Apartment availability
• Floor plans
• Bedroom and bathroom configurations
• Square footage
• Move-in specials and concessions
• Fees and deposits
• Pet policies
• Amenities
• Property photos
• Ratings and reviews
• Distance and commute information
• Lease terms
• Other property information

Apartment information may be obtained from apartment communities, property management companies, property websites, publicly available information, third-party sources, and other sources believed to be reliable.

Rental information changes frequently.

MoveRebate does not guarantee that any apartment information displayed on the website is complete, current, or error-free.

Renters should confirm all material information directly with the apartment community before applying for or signing a lease.


3. NO GUARANTEE OF AVAILABILITY, PRICING, OR APPROVAL

MoveRebate does not guarantee:

• Apartment availability
• Rental rates
• Move-in specials
• Concessions
• Fees or deposits
• Lease terms
• Floor plan availability
• Pet acceptance
• Rental qualification
• Application approval
• Security deposit amounts
• Security deposit refunds
• Move-in dates
• Property policies
• Any other term offered by an apartment community

Apartment communities establish their own rental criteria, pricing, policies, approval requirements, and lease terms.

MoveRebate and US Realty Hub do not control an apartment community's decision to approve or deny a rental application.


4. MOVEREBATE REBATE PROGRAM

MoveRebate may offer eligible renters a cash rebate of up to $250 on qualifying leases at participating apartment communities.

The availability and amount of any rebate may vary by apartment community, transaction, brokerage compensation, and applicable program requirements.

A rebate is not guaranteed.


5. REBATE ELIGIBILITY

Rebate eligibility may depend on several requirements, including but not limited to:

• Leasing at a participating apartment community
• Satisfying the apartment community's referral or locator procedures
• Properly identifying the applicable real estate brokerage, assigned apartment locator, or referral source when required
• Completing required verification
• Ensuring that another agent, locator, or referral source has not already been credited with the transaction
• Completing a qualifying lease
• The apartment community recognizing the applicable brokerage as the qualifying referral or procuring source
• The apartment community paying the applicable brokerage commission or referral compensation
• Compliance with applicable brokerage policies and law

Some apartment communities require the brokerage or apartment locator to be identified on a guest card, application, referral form, registration, or other document.

Renters are responsible for following any instructions provided by MoveRebate regarding these requirements.

Contacting, registering with, touring, or applying directly with an apartment community before applicable referral requirements have been satisfied may affect rebate eligibility.


6. WHEN A REBATE BECOMES PAYABLE

Submitting a request, searching for an apartment, touring an apartment, applying for an apartment, or signing a lease does not by itself create an obligation to pay a rebate.

Any rebate is subject to final eligibility verification.

Unless otherwise expressly stated in writing, a qualifying rebate will not become payable until the applicable brokerage has received the qualifying commission or referral compensation associated with the renter's lease and the rebate has been approved in accordance with applicable brokerage policies.

Apartment communities control the timing of their commission and referral payments. MoveRebate cannot guarantee when a participating apartment community will make payment.

Rebate processing may therefore occur after the renter has moved into the apartment.

Any rebate offered through MoveRebate is subject to applicable law and brokerage approval and administration.


7. REBATE AMOUNTS

The phrase "up to $250" means that the maximum potential rebate is $250.

Not every qualifying lease will result in a $250 rebate.

The actual amount may depend on factors including the apartment community, qualifying brokerage compensation, program terms, and other applicable requirements.

MoveRebate reserves the right to verify rebate eligibility and the applicable rebate amount before payment.

Nothing displayed on the website should be interpreted as an unconditional promise that a specific renter or lease will receive a particular rebate amount.


8. TAXES AND REBATES

MoveRebate does not provide tax advice.

Recipients are responsible for determining whether any rebate, incentive, or payment has tax consequences applicable to their individual circumstances.

Users should consult a qualified tax professional if they have questions regarding tax treatment.


9. REAL ESTATE BROKERAGE RELATIONSHIPS

Using MoveRebate, browsing apartment listings, or submitting a website form does not by itself determine or establish a particular brokerage relationship.

Any brokerage relationship that applies will be governed by Florida law, applicable disclosures, the circumstances of the transaction, and any agreements or notices provided in connection with real estate services.

Where a particular brokerage disclosure or agreement is required, that disclosure or agreement will control over any inconsistent general statement contained in these Terms.


10. USER RESPONSIBILITIES

When using MoveRebate, you agree to provide accurate and truthful information.

You agree not to knowingly provide false, misleading, fraudulent, incomplete, or inaccurate information.

You are responsible for reviewing apartment community requirements and the final lease agreement before signing.

You are also responsible for confirming important information directly with the apartment community, including rent, fees, deposits, specials, availability, lease terms, utilities, pet requirements, and qualification standards.


11. COMMUNICATIONS

When you voluntarily submit your phone number, email address, or other contact information through MoveRebate, you authorize MoveRebate, the applicable real estate professional, and US Realty Hub to contact you regarding your inquiry and related apartment locating or rebate services.

Communications may occur by telephone, email, or text message.

Message and data rates may apply.

Where separate consent is legally required for marketing or automated communications, MoveRebate may request that consent separately.

You may request that marketing communications stop at any time. For text messages, you may reply STOP where supported. You may also contact support@moverebate.com.

Consent to marketing communications is not intended to waive any rights provided by applicable law.


12. PRIVACY

Information submitted through MoveRebate is also subject to the MoveRebate Privacy Policy.

Users should review the Privacy Policy for information regarding the collection, use, storage, and disclosure of personal information.


13. THIRD-PARTY SERVICES

MoveRebate may provide information about or referrals to third-party businesses and service providers.

These may include, for example:

• Apartment communities
• Property management companies
• Moving companies
• Cleaning providers
• Utility or service providers
• Insurance providers
• Other businesses related to renting or moving

Third-party businesses are independent from MoveRebate unless specifically stated otherwise.

MoveRebate does not control and is not responsible for a third party's pricing, availability, performance, licensing, insurance, employees, contractors, policies, representations, products, or services.

Any agreement for services entered into between a user and a third-party provider is between those parties.

MoveRebate or its affiliates may receive referral, marketing, advertising, or other compensation from certain third parties where permitted by law.


14. THIRD-PARTY LINKS

MoveRebate may contain links to apartment community websites, Google services, maps, reviews, social media platforms, service providers, and other third-party websites.

MoveRebate is not responsible for the availability, accuracy, privacy practices, security, content, or operation of third-party websites.

A link to a third-party website does not necessarily constitute an endorsement of every statement, product, or service offered by that third party.


15. RATINGS, REVIEWS, DISTANCES, AND COMMUTE INFORMATION

Ratings and review information displayed by MoveRebate may originate from third-party services.

Ratings and review counts may change over time.

Distance and commute information is approximate and may vary depending on route, traffic, construction, time of day, destination, and other factors.

Users should independently verify travel times and locations that are important to their housing decision.


16. FAIR HOUSING AND NONDISCRIMINATION

MoveRebate supports Equal Housing Opportunity.

MoveRebate does not discriminate in the provision of housing-related services on the basis of race, color, national origin, religion, sex, familial status, disability, or any other characteristic protected by applicable federal, state, or local law.

Apartment search results, recommendations, filters, and informational content are intended to help users evaluate properties based on legitimate housing preferences and objective property information.

Nothing on MoveRebate is intended to encourage or facilitate unlawful housing discrimination.


17. NO ENDORSEMENT BY APARTMENT COMMUNITIES OR THIRD PARTIES

Unless expressly stated otherwise, the inclusion of an apartment community, property management company, employer, theme park, university, government entity, business, trademark, or other organization on MoveRebate does not mean that the organization sponsors, endorses, owns, operates, or is affiliated with MoveRebate.

Third-party names and trademarks remain the property of their respective owners.


18. WEBSITE CONTENT AND INTELLECTUAL PROPERTY

Original MoveRebate branding, website design, written content, graphics, logos, software, and other original materials are protected by applicable intellectual property laws.

Certain photographs, logos, trademarks, property descriptions, maps, reviews, and other materials displayed on the website may belong to apartment communities, property managers, third-party licensors, or other rights holders.

Nothing in these Terms transfers ownership of third-party intellectual property to MoveRebate.

Users may not copy, reproduce, republish, distribute, scrape, sell, or commercially exploit MoveRebate-owned website content without permission, except as permitted by law.


19. PROHIBITED USE

You may not use MoveRebate to:

• Submit fraudulent requests or claims
• Impersonate another person
• Attempt to manipulate rebate eligibility
• Interfere with the website's operation or security
• Attempt unauthorized access to website systems or data
• Introduce malicious software or code
• Use automated systems to excessively scrape or extract website content
• Use the website for unlawful purposes
• Violate the rights of MoveRebate or any third party


20. WEBSITE AVAILABILITY

MoveRebate does not guarantee uninterrupted access to the website.

The website, database, apartment information, search tools, forms, and other features may occasionally be unavailable because of maintenance, technical issues, third-party outages, updates, or circumstances outside MoveRebate's control.


21. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, MoveRebate and its content and services are provided on an "as available" basis.

MoveRebate does not make warranties regarding the completeness, accuracy, availability, reliability, or suitability of website information except where expressly required by law.

Nothing in this section limits obligations that cannot legally be disclaimed.


22. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MoveRebate, US Realty Hub, and their respective owners, licensees, affiliates, contractors, service providers, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to:

• Use of or inability to use the website
• Reliance on apartment information
• Changes in apartment pricing or availability
• Apartment application decisions
• Lease terms or disputes
• Apartment community actions or omissions
• Third-party products or services
• Third-party websites
• Delayed or unavailable rebate eligibility
• Lost or unavailable website data

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.


23. CHANGES TO APARTMENTS, SERVICES, AND REBATE PROGRAMS

MoveRebate may add, remove, modify, suspend, or discontinue website features, apartment information, participating communities, rebate programs, eligibility requirements, or other services.

Changes may occur without advance notice where permitted by law.

Changes will not override any rights that have already become legally enforceable under an applicable written agreement.


24. CHANGES TO THESE TERMS

MoveRebate may update these Terms from time to time.

The date shown at the top of this page indicates when the Terms were most recently updated.

Continued use of MoveRebate after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.


25. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.


26. NO WAIVER

Failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.


27. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law controls.
